The contractual legal consequence, in turn, has several aspects, and the paper deals with two of them. In a first, shorter part, it is examined whether contracts concluded using unfair terms and conditions are voidable only or whether they are void "ex officio," "eo ipso," "ex lege." In a second part, it is examined whether between the parties of such a contract what they just could have permissibly agreed (i.e., a "geltungserhaltende Reduktion" of the impermissible agreement takes place) applies, or whether the legal relationship between the parties is worse for the "AGB user" than what the parties just could have permissibly agreed. 2021-12-15T10:42:39Z 2021-12-15T10:42:39Z 2021 book https://library.oapen.org/handle/20.500.12657/52030 ger application/pdf Attribution 4.0 International oa_pdf-023-1639417516.pdf https://suigeneris-verlag.ch/ sui generis Verlag 10.38107/023 10.38107/023 e1c5bb0b-7471-4055-a88a-1542e5f2d4f6 382 Zurich open access
