During the 20th century the locus of care shifted from large institutions into the community. However, this shift was not always accompanied by liberation from restrictive practices. In 2014 a UK Supreme Court ruling on the meaning of ‘deprivation of liberty’ resulted in large numbers of older and disabled people in care homes, supported living and family homes being re-categorized as ‘detained’. Placing this ruling in its social, historical and global context, this book presents a socio-legal analysis of social care detention in the post-carceral era. Drawing from disability rights law and the meanings of ‘home’ and ‘institution’ it proposes solutions to the Cheshire West ruling’s paradoxical implications. 2022-03-03T12:42:20Z 2022-03-03T12:42:20Z 2022 book 9781529211993 https://library.oapen.org/handle/20.500.12657/53234 eng application/pdf application/epub+zip Attribution-NonCommercial 4.0 International Attribution-NonCommercial 4.0 International 9781529212006.pdf 9781529212013.epub https://bristoluniversitypress.co.uk/deprivation-of-liberty-in-the-shadows-of-the-institution Bristol University Press Policy Press 10.47674/9781529212006 10.47674/9781529212006 1c3eed4f-33ba-4e18-91b5-cf9a96ff57ee Wellcome Trust 9781529211993 Wellcome Policy Press 316 Bristol open access
